PACE TO DEFINE FURTHER ACTIONS IF VENICE COMMISSION’S RECOMMENDATIONS NOT IMPLEMENTED, CE VENICE COMMISSION OFFICIAL SAYS

A text of an interview with spokeswoman of the Venice Commission on foreign relations, Tatyana Mychelova.

Question: How and in which situation were the discussions on Azerbaijan held at a planetary session of the Venetian commission in Venice on Friday?

Answer: The commission took a preliminary resolution. The document was adopted without any changes without essential changes. During the session the authorities presented a new version of the document (developed on the base of results of the meeting held on 31 May), but it was discussed.

Question: What will the joint conclusion of the Venetian commission and OSCE/ODIHR on changes to the Elections Code of Azerbaijan to be adopted as a result of the session, will stipulate?

Answer: A joint resolution by the Venice Commission and the OSCE Organization for Democratic Institutes and Human Rights (ODIHR) on the changes to the Elections Code of Azerbaijan indicate to some problematic items of the draft document dated 25 April. Simultaneously it indicates the concerns on the absence of change to the composition of the elections commissions, the high level of deposits for registration of candidates and non-resolution of a problem with the restrictions set for observers from the NGOs.

Question: Could they send additional recommendations on the improvement of the elections legislation to the Azerbaijani authorities? If so, what do they envisage?

Answer: The commission will take a final resolution as soon as we receive a text of changes adopted by the Milli Majlis [parliament вЂ" Trend].

Question: Were there organized consultations with the Azerbaijani authorities in connection with the adoption of a joint conclusion? If so, when and in what form (through correspondence, or during the visit of the officials)?

Answer: For the time being we don’t have such plans

Question: If the Azerbaijani authorities agree to accept the recommendations of the Venetian commission, including those regarding the parity in the formation of the elections commissions, what steps will the commission take?

Answer: We attentively observe over the developments. In case of non-fulfillment of recommendations by the Commission, a resolution on further actions will be adopted on the level of the Parliamentary Assembly of the Council of Europe (PACE).
