“Only the President of Azerbaijan can annul a contract between Barmek Azerbaijan, an operator of the energy distributing networks of Baku and Sumgayit, and the Azerbaijani government,” Husseyn Arabul, the President of Barmek Azerbaijan, said on Monday.
"Barmek Holding signed a contract with the Ministry of Economic Development and, Azerenerji Joint Sock Company did not have a right to interfere it.
There is free market economy in Azerbaijan, which enables the foreign companies to act in the country,” he underlined.
Arabul noted that in compliance with Articles 9.3.3 of the contract on management of Baki energy network, concluded with the Azerbaijani government, the state is committed to indemnify the funds, to be paid by the subscribers referred to the first category.
"In accordance with the contract, the compensation is to be repaid within the shortest period, but we have waited for 3 years.
The issue has its resolution in Article 5.2.2 of the contract on energy purchase with Azerenerjy. We function under this contract,” he underlined.
Arabul noted that Barmek Azerbaijan did not have problems with Azerenerjy JSC. "Otherwise, the JSC can appeal to the court, as the disagreement between the companies can be resolved in the international courts in compliance with the contract. Besides, I am not against the consideration of the case in the Azerbaijani courts,” he stressed.
The President of Barmek stated that it would not leave the country and was eager to manage the energy networks for 21.5 years more (the contract was concluded for 25 years).
As to entrance of RAO EES to the Azerbaijani energy market Arabul said the company with �well-known’ experience in Georgia and Moscow would not be able to manage the energy network in Azerbaijan.
