DEPUTY MINISTER NATIK AMIROV COMMENTED ON SITUATION WITH GARADAG CEMENT

"It is the right of any tax payer to apply to the court in case he does not agree with the decision of the tax body”, deputy Minister of Taxes Natik Amirov told Trend on 7 September commenting on the statement of the Open Joint Stock Company (OJSC) Garadag Cement on the intentions to take the Tax Ministry to the court.

"If there is a court procedure, we will represent our position, which we have”, deputy Tax Minister said.

Commenting on the possible release from payment of financial sanctions as the company has already reimbursed the amount of the major debt, Amirov noted that during discussion of the tax payment issue by Garadag Cement, the proposals of the company will be studied, as well as the issue on the reasonableness of their demands.

Earlier Garadag Cement paid off the amount of the basic tax debt of over 13 billion AZM. The remaining sum is some 3 billion AZM, which formed on the account of fines.

It should be noted, the Department of preliminary investigations of crimes under the Tax Ministry of Azerbaijan filed a suit against the enterprise by the Article 213.4 (tax evasion in large amounts).

On the results of the field mission at the company from 21 February to 24 May 2005 and covering the OJSC operation from the 1 January 2003 to 1 January 2005, tax bodies were presented the documents with the distorted information on revenues and expenditures. Thus, it was revealed, that the company had evaded tax payments to the state budget in the amount totaling to13 289,5 million AZM. .
