Azerbaijani ombudsman applies to Constitutional Court

Azerbaijani Ombudsman appealed to the Azerbaijani Constitutional Court concerning a conditional sentence for women who have committed less serious crimes and women with children under eight years.

Ombudsman Elmira Suleymanova applied to the court with inquiry. She indicated disparity of Article 79.1 of the Criminal Code to the Constitution and asked to exclude this article, the Constitutional Court told Trend on Tuesday .

The court can postpone term of a sentence for pregnant women or women with children under eight years till they reach eight, as well as those convicted for grave crimes against a person, except for women imprisoned for more than five years, stated in this article.

When a child reaches the age of eight, the need for a mother to serve the sentence is the reason that a child is deprived of maternal care. It leads to serious problems for a child. Ombudsman asked to give such women a conditional sentence.

Ombudsman received statements on this issue from citizens and the State Committee for Family, Women and Children.
