The new Code of Administrative Offenses, adopted by the Majlis (Parliament) last year, entered into force in Turkmenistan in January 2014, the local media reported on Thursday.
Some criminal offenses were transferred to the category of administrative offenses as part of the humanization of the legislation.
The matter rests in the offenses connected with reckless infliction of injury of moderate severity, libel, etc.
The code expanded the powers for ensuring the proceedings on administrative offenses, namely, administrative detention, personal inspection, and inspection of personal property.
The code envisages the seizure of property and documents (except a passport or other identity document), suspension from driving, the seizure of vehicles, and prohibition of using a vehicle. The law permits use of such measures to temporarily ban activity.
The legal entities act as the entities of administrative relations alongside physical entities after innovations. There are more than 120 legal formulations, the entity of which is a legal entity.
The offenses include acts against the rights of citizens, health, sanitary and epidemiological condition, property, the environment, subsurface use, protection of monuments of history and culture, the licensing of certain activities, in the sphere of economic activity, labor law and labor protection, communication and information, business activity, migration legislation and others.
