The privilege from arrest of ex-speaker Rasul Guliyev, the chairman of the Azerbaijan Democratic Party (ADP) balloted for the parliamentary elections, was raised at the General Public Prosecutor’s 27 August sentence, the General Public Prosecutor’s Office told Trend.
The articles 70 and 151 of the Elections Code grant a privilege from arrest to the candidates registered at the elections. Guliyev’s candidacy was registered in the Khatai 4th constituency 36 on 27 August.
The General Public Prosecutor gave instructions to the Ministry of Internal Affairs to implement sentence of the Sabail district court of Baku city on imprisonment in regard to Guliyev.
The press-service of the General Public Prosecutor’s Office spread reports on abuse of official authority by Guliyev. “Guliyev misappropriated state property during his work as the Director of the Azerneftyag oil refinery plant from 1990 to 1995.
He monopolized refining and export of oil at the post of the Vice-President of the State Oil Company of Azerbaijan (SOCAR), the head of the Central Board on Refining of Oil and Gas, the deputy of the Prime-Minister and the chairman of the Milli Majlis (Parliament).
He involved the supervision of the Azerneftyag production association (PA) working after him in signing of illegal contracts on export of oil products with representatives of foreign firms.
Though the foreign firms did not implement the terms of the previous contracts and pay the entire cost of the transported oil products, Guliyev signed new contracts with them and misappropriated the state property in the amount of $107 million. He also caused damage to the state interests in the amount of $10.7 million exceeding his authority,” the press-service said.
The Sabail district court made sentence on accusation in misappropriation at the article 179.3.2 of the Criminal Code, official falsification at the article 313 and exceeding of official authority at 309 in regard to Guliyev on 10 October 2000. The courts made a verdict on his arrest as a result of his abscond. Guliyev is under search.
