Court Rejected Appeal of Azerbaijani Opposition Leader

Azerbaijan, Baku, 27 May / corr. Trend K. Zarbaliyeva/ The appeal made by the chairman of Popular Front Party of Azerbaijan (PFPA) to close his criminal case, has been rejected.

The legal proceedings on the appeal to close the criminal case against PFPA chairman Ali Karimli ended in the Nasimi District Court of Baku on 26 May. The criminal case was filed in 1994 for illegal storage of ammunition.

The lawyer of Ali Karimli, Elchin Gambarov, stated that they will appeal against the verdict of the court.

In 2006, Karimli appealed the Passport Office of Interior Ministry to get a new passport as his previous one has expired. However, he was denied a passport as the criminal case filed against him in the Nasimi District Court of Baku in 1994 was not closed as yet.

According to lawyer, for past 12 years the criminal case has been opened, while it was supposed to be closed in 5 years span in line with the procedural criminal legislation.

The Nasimi District Court has rejected Karimli's appeal.

They appealed against the verdict of the court, but the Appeal Court upheld the decision of the Nasimi District Court.

The Supreme Court, which had examined the appeal, canceled the verdict of the Appeal Court saying that this appeal belongs to the criminal execution and the appeal should be examined in a civil court examination manner.

So, the Supreme Court guided Karimli how he can appeal in line with the requirements of the procedural criminal legislation.
