Azerbaijan, Baku, 7 November / Trend corr. R.Novruzov/ An Azerbaijani won a trial against Russia at the European Court of Human Rights.
The European Court announced illegal the verdict of the Russian court for Azerbaijani citizen Adil Ismayilov, who allegedly did not declare a sum of $21,348 when passing the Russian border, the European Court said.
The Russian court seized the funds from Ismayilov and kept him in prison for six months.
The European Court took into account that the undeclared funds were legally obtained and therefore Russian court did not have the right to seize them. The decision was made during a jury vote (6:1). The European Court decreed that the verdict of the Russian court violated the Protection of Property Bill. Ismayilov received a compensation of €25,000.
On arrival to Moscow in November 2002, Ismayilov was accused of smuggling USD 21,328 (€17,059), which he got by selling his apartment in Baku. The Russian Court sentenced him to 6 months of imprisonment with seizure of the funds. Ismayilov, guided by the Protection of Property Bill, applied to the European Court on Human Rights, requiring the seized funds back.
