The Constitutional Court of Azerbaijan adopted a decision regarding the appeal of the Baku Court of Appeal.
Baku Court of Appeal asked the Constitutional Court of Azerbaijan to comment upon the article 157.5 of the Criminal Procedure Code under articles 154.4, 156.2 and 163.2 of the Code, the Constitutional Court told Trend.
According to the decision regarding the appeal, article 157.5 of the Criminal Procedure Code should be applied only in compliance with requirements of Articles 154.4, 156.2 and 163.2 of the Code.
When the court considers arrest as a preventive measure the court may substitute the prison's arrest with house arrest, if there is a defense petition and there is no need to isolate the defendant from society through arresting him.
