The European Court of Human Rights adopted another decision on the case against Azerbaijan - on the Jafarli's and others' cases against Azerbaijan.

Claimants Safarali Jafarli, Valida Bagirzade and Elchin Jafarov stated that due to non-fulfillment legal judicial decision of July 9, 2002 their rights for a fair court examination and right for property, provided by the first paragraph of Article 6 and Article 13 of the Convention, as well as Article 1 of the Protocol 1 of the Convention, are violated, Legal Education Society told Trend.

The European Court of Human Rights examined the case and decided to consider a suit as adopted under the first paragraph of Article 6 of the Convention, as well as Article 1 of Protocol 1 of the Convention (non-fulfillment of judicial decision of July 9, 2002), the European Court didn't accept the remaining claims.

The Court has also adopted a decision on violation of claimants rights for a fair court examination and for property, provided by the first paragraph of Article 6 (fair court examination) as well as the Article 1 of the Protocol 1 of the Convention (right for property).

The court admitted that an investigation under Article 13 of the Convention is not necessary. The Court also considered that the claimants have not raised any claims under paragraph 60 of the judicial rules on fair compensation. That's why the Court decided that there is no need to pay any sum to the claimants.
