The Azerbaijani Constitutional Court has interpreted the Article 178.8 of the Civil Code upon the Supreme Court's request.
The constitutional case on the Article 178.8 of the Civil Code was considered at the process chaired by Farhad Abdullayev.
The Constitutional Court made a decision that the Article 178.8 should be applied in accordance with the Articles 146.1, 146.2, 178.1 and 178.2 of the Code and in accordance with Article 113 of the Housing Code.
If the cooperative members and other shareholders of the cooperative unit fully pay a share for cooperative apartment, cottage, garage and other structures, these persons have the right to ownership of this property and the right to use them. And after the registration of real estate in the state register, they receive the right to dispose on this property.
