EU projects recommend Azerbaijan to adopt state program on approximation of legislation

The Coordinating Bureau of the European Union’s (EU) Tacis program and the Project on implementation of Agreement on Partnership and Cooperation (APC) between the EU and Azerbaijan) drafted proposals on the development of the State Program on approximation of the legislation. Asgar Alakbarov, the Executive Director of the Coordinating Bureau of Tacis, told Trend the relevant proposals had been sent to the Cabinet of Ministers of Azerbaijan.

"The proposals concern the establishment of the State Program on approximation of the legislation in 15 spheres under the APC, including the legislation of financial and banking sectors, registration of legal entities, copyrights, sanitary and phyto-sanitary and sanitary control, regulation of issues of rivalry, accountancy, taxation, in particular, indirect one, defense of labor, ecology and natural resources, use and preservation of radioactive substances, implementation of state purchases," Alakbarov noted.

According to Alakbarov, the Cabinet of Ministers sent the proposals to the Ministries
and administrations to consideration. "Their opinions will concern the necessity of development and adoption of the program in whole and their views on the document. At present all ministries have presented their reply except the Health Ministry,” he noted.

The Executive Director said that the State Program, in case of adoption, will be implemented in three stages, the proposals do not define the urgency of their execution. The first stage envisages the approximation of the legislation in the spheres which concern the achievement of membership at the World Trade Organization (WTO), which includes technical standards and certification standards, rivalry and different trade aspects. The second stage is focused on the approximation of the legislation in the spheres of customs law, social issues, implementation state purchases and taxation. The third stage will cover the approximation of the legislation in the sphere of intellectual property, transport, banking and financial sectors. Definition of the spheres in the third stage does not necessarily mean the non-priority, but implies that this sphere is more favorable in this pretext and major work on approximation of the legislation has been implemented,” he underlined.

According to Alakparov, at present the first draft state program is ready. "In case the idea is successful, the adoption of the state program will be regulated in accordance with the relevant presidential decree," he noted.
