ICC prosecutor says Libya can try Gaddafi's son, ex-spy chief

The chief prosecutor of the International Criminal Court (ICC) said Tuesday that Libya can try the son of slain leader Moamer Gaddafi, Saif al-Islam, inside the country, dpa reported.

"If they (Libyans) prosecute the case, we will discuss with them how to inform the judges, and they can do it, but our judges have to be involved," ICC prosecutor Luis Moreno-Ocampo told reporters in Tripoli.

After holding talks with several Libyan officials, Moreno-Ocampo, stressed that the most important thing is that Saif al-Islam Gaddafi is captured and we have "to ensure cooperation."

The ICC, which is based in The Hague, Netherlands, has already charged Saif al-Islam and Gaddafi's former intelligence chief, Abdullah al-Senussi, with crimes against humanity.

The two men were arrested by Libyan fighters in southern Libya over the weekend.

Moreno-Ocampo's visit to Tripoli comes as the country's interim rulers insist on putting both men on trial in Libya.

Earlier on Tuesday, Ocampo said: "The issue of where the trials will be held has to be resolved through consultations with the court. In the end, the ICC judges will decide. There are legal standards which will have to be adhered to."

"Their arrest is a crucial step in bringing to justice those most responsible for crimes committed in Libya. This is not a military or political issue, it is a legal requirement," he said in a statement.

International rights groups voiced concern that the two men might face the same fate as Gaddafi, who was killed after he was arrested alive in his hometown Sirte.

The ruling National Transitional Council promised an investigation into the controversial death of Gaddafi and another son, Mutassim.
