BAKU, Azerbaijan, January 28. President of Azerbaijan Ilham Aliyev has signed a law amending the country's Migration Code, Trend reports.
The law establishes rules for the release of foreigners and stateless persons who have been forcibly placed in illegal migrant detention centers.
The period of detention of foreign nationals and stateless persons in these centers will be calculated from the moment the decision to place them in the center is made.
The issue of extending the detention period or releasing these individuals must be resolved before the expiration of the period specified in the decision regarding their placement. The head of the detention center must inform the relevant executive authority about this verbally or in writing one business day before the expiration of the period. Based on a court decision, except in cases of extension, the relevant executive authority will make a decision on the extension or release of foreigners and stateless persons. Additionally, the decision regarding the extension or release of individuals must be executed immediately upon receiving that decision.
According to the articles added to the Code, if the term specified in the decision regarding the placement of a foreigner or stateless person in the center expires and has not been extended, the head of the center will, without the corresponding decision, create a protocol and release the person held in the institution, notifying the official or judge who made the decision to place the foreigner or stateless person in the center.
The head of state signed the decree in connection with the enforcement of the relevant law.
