The doctor, who operated on journalist Rasim Aliyev, may be sentenced to one to three years, lawyer Nijat Gezalov told Trend August 12.

"If it is proved that the timely medical care was not rendered to Rasim Aliyev, a criminal case may be filed against the doctor under the article 142.3 of the Criminal Code of Azerbaijan," he said.

The lawyer said that this would become known during the investigation.

"There is an article about the failure to render assistance to the patient (142.3) of the Criminal Code of the Azerbaijan Republic," he said. "If this is proved during the investigation, the doctor, who operated on Aliyev, may be held responsible."

He thinks that there are some controversial points in the case of the journalist's death.

"Perhaps, all these issues will be clarified during the investigation," he said. "The testimony of parents, doctors and others differ. This complicates this case. However, I am confident that the investigative bodies will clarify everything. They will also reveal whether a doctor is guilty or not."

Rasim Aliyev, working for Ann.az website, was beaten and as a result, suffered multiple injuries on August 8. Aliyev died in a clinical medical center on August 9.

Baku's prosecutor's office filed a criminal case under article 126.3 of the Criminal Code of the Azerbaijan Republic (intentional infliction of harm resulting in death of the injured person). An operational-investigative group consisting of police officers was established.

"The president instructed the appropriate authorities of the Republic of Azerbaijan to fully investigate the incident in a short period of time, find the perpetrators and bring them to justice, and the investigation is supervised by him personally," Ali Hasanov, the Azerbaijani president's Aide for Public and Political Affairs, said earlier.
