The Cabinet of Ministers of Uzbekistan adopted a resolution, under which gas suppliers will have to reimburse actual damages and lost profits due to non-delivery or incomplete delivery of gas to consumers.
A change to amendments to some resolutions of the Government of the Republic of Uzbekistan, were adopted to 'improve responsibility of gas supply organisations on performance of contractual obligations to ensure the smooth functioning of natural gas to meet the needs of businesses in their production activities', the document says.
The resolution introduced amendments to the rules of gas supply to customers approved in 2000 and to the position on the order of settlement between the consumers of natural gas and gas-supplying organisations (2005).
The paragraph: 'a provider organisation or territorial gas transmission company must reimburse the actual damage and lost profits caused by non-delivery or failure to supply gas to gas supply contract subject to the provisions under these rules to the consumer in.' was added to the first document
The same requirement is included in the second document: 'The supplier or gas supply organisation shall reimburse the consumer in the prescribed manner the actual damage and lost profits caused by non-delivery or incomplete delivery of gas under the contract."
National Holding Company Uzbekneftegaz together with the Ministry of Justice is charged to bring the contracts signed with consumers of natural gas into conformity with the decision made in two months.
In addition, guidelines on the mechanism of interaction with customers in order to implement standards set out in the decision must be approved within a month.
Supply of gas to consumers is made by JSC Uztransgaz (included in the structure of NHC Uzbekneftegaz) to consumers who have direct access to JSC Uztransgaz trunk pipelines under direct contracts for metering devices installed on the interface of gas pipelines, gas supply or territorial businesses at the interface between gas pipelines and gas networks - for self-sustained gas meters for resale to consumers who do not have direct access to the pipelines.
