BAKU, Azerbaijan, October 31. Azerbaijan is implementing new regulations regarding the detention periods for foreigners and stateless individuals held in the Center for the Detention of Foreigners and Illegal Migrants, Trend reports, referring to the Azerbaijani Parliament.
Today's session of the Azerbaijani Parliament Committee on Legal Policy and State Building discussed an amendment to the Migration Code, which outlines the update.
The amendment calculates the duration of detention from the moment individuals arrive at the center, based on the placement decision. The placement decision cannot detain foreigners and stateless persons for longer than the specified period.
Before the end of this period, authorities must address whether to extend the detention or release these individuals. The Head of the Center is required to inform the relevant Executive Authority 1 (one) working day before the expiration of the detention period, either verbally or in writing.
Based on a court ruling, except in cases of extension, the relevant Executive Authority will decide whether to extend the detention or to release (or discharge) these individuals.
Article 82.6 of the Code requires the Center to execute decisions regarding the extension of detention or release immediately upon receipt.
