European Court fines Azerbaijan

The European Court’s decision on Azerbaijani citizen Mikayil Mammadov’s appeal against Azerbaijani Government was announced, Azerbaijani Government’s Plenipotentiary Representative at the European Court Chingiz Asgarov told Trend News today.

The European Court's decision on Azerbaijani citizen Mikayil Mammadov's appeal against Azerbaijani Government was announced, Azerbaijani Government's Plenipotentiary Representative at the European Court Chingiz Asgarov told Trend today.

The European Court's decision confirmed that the right to life specified by Article 2 of the European Convention has been violated. The court fined Azerbaijan in the amount of 20,000 euro.

Forty-eight-year old Mammadov is a refugee from Gubadli region. At present he resides in Sumgayit. Mammadov who lives with his family in the hostel repaired several empty rooms of the military administrative building and move to the building without any official permission.

Two official and police officers entered the new place of residence of the family to forcibly evict them from the building. Mammadov's wife Chichak Mammadova burned herself as a sign of protest and several days later died from severe burns in March 2004.

Mammadov complained of violation of Article 2 of the Convention (right to life), saying that officials of the city executive power and police officers are responsible for his wife's death.

Mammadov said these persons had entered his house illegally, used excessive force and had not taken necessary measures to save his wife's life. The authorities did not investigate the case thoroughly.

The European Court has adopted 21 decisions about Azerbaijan.
