Azerbaijan,Baku/ Trend corr. K. Zarbaliyeva/ Nadir Aghabalayev, a former officer of the Department of the Militarized Security Service of State Oil Company of Azerbaijan (SOCAR), who was acquitted in the accusation of a premediated murder, has brought an action against the leadeship of the Azerbaijan Domestic Ministry, State Public Prosecutor's Office, Baku City Publi Prosecutor's Office, and Public Prosecutor's Office of Yasamal District of Baku City. As a lawyer of Mr. Aghabaliyev, Vugar Hasayev told Trend, his client, accused on Article 120.2.3 of Criminal Code of Azerbaijan Republic, in his suit brought in the Yasamal District Court of Baku City, insisted on the compensation at an amount of AZN 200.000 for material and moral damage caused to him from those persons, who had been responsible in his ungrpounded arrest and held an unbiased investigation.
A preparatory sitting presided by Judge Isa Ismayilov, has ben held in in the Yasamal Court of Baku City due to the action initiated by Mr. Aghabalayv today . The court hearings on the suit has been fixed to April 24, 2007.
Notably, the Azerbaijan Court for Serious Crimes passed verdict of "not guilty" to Mr. Aghamaliyev. According to the appeal initiated by the State Public Prosecutor's Office, investigations have been held in the Azerbaijan Court of Appeals and Supreme Court of the Country, and the sentenced passed by the court of first instance has remained in force.
