The Chairman of the Supreme Court of Azerbaijan does not support removing property confiscation from the penal system. Confiscation of property is rarely used in practice, Supreme Court Chairman Ramiz Rzayev told Trend.
He said the law permits confiscation of property only in two cases: if the property is an instrument of a crime or if it is proven that this property has been acquired by criminal means. In other cases, confiscation of property can not be used as punishment.
"For example, someone, receiving a bribe or assigning state property, bought a house. If it is proved that the house was purchased as a result of these actions, in this case, the property is confiscated. In all other cases, the confiscation of property is not allowed," Rzayev said.
A number of experts and lawyers believe that the confiscation of property leads to a violation of the rights of heirs to the property.
