Azerbaijan, Baku, 22 August / Trend corr. K.Zarbaliyeva / A former investigator of the Investigation Department of the Baku City Public Prosecutor's Office who was sentenced to five years in jail with charges of bribery, filed a suit the Supreme Court.
The Baku Appeal Court postponed a judicial sitting on appeal against sentence toward Mahir Nagiyev for this reason, Osman Kazimov, Nagiyev's lawyer said to Trend .
On 30 October 2008, the Nasimi District Court sentenced Nagiyev, the former investigator of the Investigation Department of the Baku City Public Prosecutor's Office, who was charged with bribery and abusing his authorities to with three-month jail.
According to the order of the Prosecutor General dated 2 July, Nagiyev was dismissed from the public prosecutor's office and was deprived of all ranks.
Investigation into the criminal case conducted by the Counter Corruption Department at the General Public Prosecutor's Office revealed that when he worked as investigator on important matters at the Investigation Department of the Baku City Public Prosecutor's Office, he took bribe from Baba Mahmudzade and Ehtiram Ahmadov in order not to arrest them.
A criminal case was filed against the former investigator on Articles 311.3.2 (repeated bribery), 309.1 (exceed of authorities) and 308 (abuse of authorities) of the Criminal Code at the Counter Corruption Department.
Nagiyev, who was charged with bribery, was sentenced with five-year imprisonment. Under the sentence of the court, Nagiyev is banned to work at bodies of public prosecutor's office.
According to the lawyer, appeal was filed at the decision of preparatory meeting of the Baku City Appeal Court.
The procedure on appeal case was postponed until the examination of appeal by the Supreme Court.
