Azerbaijan impositions strict payments for green space damage

BAKU, Azerbaijan, October 2. Azerbaijan is establishing legal grounds for payments to the State Fund for Environmental Protection concerning damage to green spaces, Trend reports.

The issue is addressed in the proposed amendment to the Law "On Environmental Protection," which was discussed today during a meeting of the Azerbaijani Parliament's Agrarian Policy Committee.

The draft highlights that depending on the extent of damage caused by the destruction of green spaces, current legislation provides for both administrative and criminal liability for offenders, as well as civil liability requiring them to compensate for the damage.

According to Article 19.3 of the Law "On the Protection of Green Spaces," the rules for calculating and compensating for damage to green spaces are to be established by the relevant executive authority (the Cabinet of Ministers).

In line with point 4.2 of the "Rules for Calculating and Compensating for Damage to Green Spaces," approved by the Cabinet of Ministers Resolution No. 421 of the Cabinet of Ministers dated October 27, 2016.

The amount owed for damage to green spaces must be paid by responsible individuals, officials, or legal entities within thirty days in accordance with the "Regulations on the State Fund for Environmental Protection" approved by Resolution No. 41 of the Cabinet of Ministers of the Republic of Azerbaijan dated February 22, 2001.

Payments are to be made to the designated bank account of the State Fund for Environmental Protection, with proof of payment required to be submitted to the Ministry of Ecology and Natural Resources of Azerbaijan.

Currently, while damages to green spaces are compensated by the State Fund for Environmental Protection, such provisions are not explicitly outlined in the Law "On Environmental Protection.".

Given that the legal basis for contributions to the State Environmental Protection Fund is indicated in part three of Article 27 of the Law "On Environmental Protection," there arose a necessity to amend this provision.
