A lawsuit was filed on the head of the Yasamal District Religious Community. Head of the religious community Mirvaleh Movsumov is charged of self-willful capture of land (violation of the right to property).
The suit which was filed on Movsumov by the Yasamal District Police Office finished and the case was sent to the district court for examination, Lawyer and Representative of the religious community Mukhtar Mustafayev told Trend on May 4.
The lawyer said Movsumov is accused of capture of 9-square-meters of territory where the Muhammad Prophet Mosque was located.
The Yasamal District Court passed a special resolution in November 2008 and it did not come to power, he said.
The appeal was lodge on the court's resolution. As the appeal was not examined in fact, it is illegal to file a suit on Movsumov, the lawyer said.
On Nov. 28, the Yasamal District Court passed a verdict supporting the Yasamal District Administration's request to raze the Muhammad Prophet Mosque at 190 Murtuza Mukhtarov St.
A non-residential building will be built on the property.
Mosque representatives lodged a complaint with the Baku Appeals Court requesting that the Yasamal District Court's verdict be annulled and a new decision be passed.
The Yasamal District Administration razed the mosque on April 26, although a juridical resolution did not come to power.
