BAKU, Azerbaijan, September 6. It is necessary to work out aspects of control and fulfillment of obligations on coal and other fossil resources, lawyer, and climate law expert Wendy J. Miles (UK) said at the international conference “Law & Climate” today, in Baku, Trend reports.
“Neither coal nor any other fossil resources are directly mentioned in international documents. However, this interpretive guideline is a progressive approach to interpreting those words in agreements signed by all parties. These are important points, and the question arises as to how exactly we can monitor the fulfillment of these commitments and where exactly they should be enforced.
The Paris Agreement, like the Framework Agreement, includes a useful dispute resolution mechanism. Of course, we can revisit the issue of forced settlement, but it is still not a binding solution. However, only three countries have taken advantage of this provision. Consequently, when we move to jurisprudence, it is important to understand why these cases are so important in the system of international law,” she said.
