Azerbaijani Parliament Adopts Bill on Fighting Monopolies

Azerbaijan, Baku / corr Trend I.Alizade / The permanent parliamentary commission of the Azerbaijan adopted a draft law, envisaging the establishment of the favorable condition for the free entrepreneurship and the healthy rivalry in the country, in the second reading. On 25 Dec, the Milli Majlis [Azerbaijan Parliament] discussed and adopted in the second reading, the Competition Code.

According to Ziyad Samedzade, the chairman of the parliamentary commission for the economic policy, the Code has undergone the first reading a year ago. "Later on, a special working group was established, at the MPs' proposal to improve the law. The bill was almost reviewed, and as a result the numbers of articles were reduced from 97 to 82," he said.

Samedzade said that the initial variant of the Competition Code envisaged the priorities and privileges for the employees of the competition bodies. After the improvement, these issues were removed from the Competition Code and the employees of the competition bodies will be regarded as the state employees.

The Competition Code defines the legal basis for ensuring and the defense, of the free and healthy competition in the sphere of the business activities. The document rules out the signing of the agreements, restricting the rivalry of the market subjects leading to the monopolization of the economy. The key objective of the Competition Code is to prevent such negative situations. The Code stipulates the actions for strengthening 'entrepreneurs' efforts for the rivalry and the preservation of the domestic market.

The Code envisages the state control over the observation of the legislation, the development and realization of the state rivalry policy, the prevention of unfair rivalry etc.
