A suit has been filed against Azerbaijani Press Council.
Newspaper Nota has filed a suit against the Press Council in the Binagadi District Court over violation of freedom of thought and harming business credibility of the newspaper, lawyer of the newspaper Intigam Aliyev said to Trend .
The newspaper is disgruntled by the fact that the Press Council has included the newspaper to the list of "racket" newspapers which composed 71 media outlets.
The Press Council has no powers to adopt a decision regarding Nota as the newspaper is not member of the Press Council. This power is envisaged neither by legislation nor by founding documents of the council.
The plaintiff demands to recognize Press Council decision dated to April 24, 2009of as illegal, to refute the information and fine the defendant for damages to newspaper's credibility in the amount of 1 manat.
Nota published article entitled "Who is 'swindler' Hikmat?" or "Relative of Minister Fuzuli Alakbarov and Unknown MP" based on complaints it received in February.
Head of Mingachevir Tikinti OJSC Hikmet Heydarov addressed the Press Council claiming that the published article is untrue and hurts his dignity and honor and harms his business credibility.
The Press Council has considered the complaint and included Nota in the list of "racket" media on April 24, 2009.
The decision of the council pointed out that the newspaper Nota" does not follow ethical principles and therefore it has been described as "racket."
In a statement sent to the court of Nota said that the decision of April 24, 2009 by Press Council violated freedom of thought provided by the Azerbaijani legislation and Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms.
