Azerbaijan will next year adopt a law authorizing the detective activities.
With the participation of representatives and experts from the relevant agencies, work is underway on the bill, a source in law-enforcement agencies told Trend. The international experience was taken into account, considering the moral and ethical values and mentality of Azerbaijan.
The bill will be submitted to Parliament next year.
MP Chingiz Ganizade considers it is important to be very careful in this issue. According to the MP, if the preparation of the law will resolve the question of liability of customers and performers, this issue can be discussed with the participation of law-enforcement officers, lawyers and professionals.
"The mentality and spiritual values must be taken into account in this issue," he said.
According to MP, the permission for such activities will be abused.
The MP said that the Azerbaijani Constitution prohibits the spread of personal information, taking photo and video.
"From this point of view, the activities of the detectives may contradict to the Constitution," said Ganizade.
There is a need for private detective organizations, said the lawyer Fuad Agayev. Noting that most countries worldwide have allowed detective activities, Agayev said, adding that all depend on how the bill will be prepared.
The lawyer said that Azerbaijani legislation creates serious obstacles for the activities of private detectives.
"Under the Constitution and laws of Azerbaijan, the specific activities of private detectives are considered typical for law-enforcement agencies, and such activities are in competence of only law-enforcement agencies," Agayev said.
Lawyer-expert Khanlar Alekperov believes that it is important to create alternative organizations to law-enforcement agencies.
"Searching for missing persons, offenders, citizens wishing to install surveillance over their spouses do not want government agencies to know about this information. In such cases, they want to use the help of detectives," said Alekperov.
