Azerbaijan’s Electoral Code amended

According to amendments adopted at a meeting of the Azerbaijani parliament on Friday, relevant election commissions should provide information to media about the candidates, who have been registered under the relevant constituency within 24 hours (in the current legislation this period is defined as 48 hours).

According to amendments adopted at a meeting of the Azerbaijani parliament on Friday, relevant election commissions should provide information to media about the candidates, who have been registered under the relevant constituency within 24 hours (in the current legislation this period is defined as 48 hours).

A decision on each complaint received by the Election Commission during the election shall be made within three days, and on election day or the next day is taken immediately and submitted to the plaintiff. Under the proposed change, the decision on each complaint, if there is less than 30 days before election day, shall immediately be taken within two days (but no later than election day) and presented to the plaintiff.

The current law states that complaints on the decisions of election commissions should be considered in the courts within three days (if the Code does not set a shorter period of time). Under the new changes, appeals against decisions of election commissions should be considered in two days if there is less than 30 days (but no later than the election day) to election day, but complaints received on the election day and the next day, must be considered immediately.

Due to amendments made to the Electoral Code, the Administrative Procedure Code and the Code of Civil Procedure were also amended.

According to another amendment adopted by the parliament, decision of the expert on the complaint is declared immediately after its adoption, or published together with the decision of the relevant election commissions (available on the website) not later than 18:00 and submitted or sent to the plaintiff. This term is defined in 24 hours under current law.

Under another amendment, the official announcement of the referendum results, together with the text of the act adopted by referendum shall be published by the Central Election Commission (CEC) no later than 30 days after the voting. Under the current law this term is defined in 20 days.

According to another adopted amendment, the CEC shall announce the results of municipal elections in Azerbaijan no later than 25 days from the date of the election. Under current law this term is defined in 30 days.
