Criminal Case on Former Commander of Azerbaijani Internal Troops of to be Reviewed

Azerbaijan, Baku / Тrend corr K. Zarbaliyeva / The Azerbaijani Court of Appeals will review the case against the former commander of Azerbaijani Internal Troops, Fahmin Hajiyev. According to findings of the European Court on Human Rights, the right of the former commander to a just court examination was infringed and his case has to be reviewed. Thus, a court hearing will be held presided by Judge Gayil Mammadov on 24 May.

The cassation appeal by Hajiyev on the rehabilitation of the term of submission of the appeal is under execution of Judge Alakbar Huliyev. The date of the hearings on the appeal is being defined.

The European Court passed sentence against Azerbaijan due to the appeal of Hajiyev at the end of 2006. Due to the infringement of his rights the Court decided that Azerbaijan should pay €5,000 compensation to Hajiyev. The decision was executed.

Hajiyev was arrested in 1994 and sentenced to 15 years in prison. In 2004, he was pardoned by the Azerbaijani President.
