Azerbaijan, Baku / Trend corr. К.Zarbaliyeva / Huseyn Arabul, the president of Barmek-Azerbaijan, and six employees of the company were dismissed from the court room.
Arabul was sentenced to eight years probation, five years conditional discharge and denied the right to be employed or leave the country for two and a half years.
Guner Ismayil, Director of the Technical Department and the vice president of the company, was sentenced to five years probation and seven years conditional discharge. Vafa Agayev, acting Director of the Department for Technical Operations, was sentenced to one year six months and 28 days which was suspended.
Mahir Novruzov, former General manager, was sentenced to two years probation and four years conditional discharge, Valkh Askarzadeh to three years probation and five years conditional discharge, Askar Askarzadeh to six months and two days in prison and Chingiz Abdullayev to two and a half years and twenty days in prison.
Huseyn Arabul, Omar Guney and Vafa Agayev were fined for causing damage to the BakuElcctricShabaka (Baku Electricity Network). Arabul does not agree with the decision of the court.
Notably, the President of the above-mentioned company, Mr Arabul is accused of Articles 179.3.2 of the Criminal Court of Azerbaijan Republic (misappropriation or dissipation), 308.2 (exceeding one's commissions), and 313 (service falsification). Based upon the above-mentioned accusations, the court ordered him not to leave the country.
An investigation revealed that based upon an agreement signed between the Azerbaijani Economic Development Ministry and Turkish company Barmek Holding, the rights to management of the Baku Electric Power Distributing Company (BakuElektrikShabaka OJSC) would have been passed to the Economic Development Ministry for a term of 25 years. According to the investment programme stipulated in the agreement, the company was to invest $51 mln within five years, but actually did nothing in this respect.
The investigation also disclosed that employees of Barmek LLC misappropriated the sum of AZN 9,143,940, which was collected from the consumers.
