The Constitutional Court of Azerbaijan decided to reduce the retirement age for adoptive women parents, guardians and stepmothers.
This decision was made at the request of the Ombudsman Elmira Suleymanova regarding the check-up of conformity of Article 8.1 of the Law on Pensions with the Constitution, the Constitutional Court told Trend.
According to this article, women who born five or more children and bring up them until they reach the age of eight, and if they have been insured for at least 10 years, the labor pension is appointed with a decrease in the retirement age for a year for each child.
According to the court decision, the right to pension for adoptive women parents and step-mother is equated to the right to retire for own mother.
Thus, women who adopt five or more children and bring up them until they reach the age of eight, and stepmothers who bring up five or more children under the age of eight years, labor pension is appointed with a decrease in the age of retirement for one year for each child.
Constitutional Court recommended the parliament to remove this discrepancy.
