State prosecutor Ramazan Hadiyev urged to sentence Khadija Ismayilova to nine years in prison at a session of the Baku Court of Heinous Crimes August 21.

Judge Ramella Allahverdiyeva is chairing the session.

Hadiyev initially informed the court about the criminal acts of the defendant, in which she was charged. The prosecutor said that during Ismayilova's leadership over the Baku bureau of Radio Azadlig, she misused her powers and was engaged in tax evasion. So, she tried to persuade employees not to sign labor contracts and attracted them to work through service contracts. But, despite the conclusion of a service contract, conditions stipulated by the labor contract were created for workers. Ismayilova obtained paying taxes at a rate of 4 percent, provided for service contracts rather than the 14 percent tax provided for labor contracts. Thus, she caused damage to the state budget by not paying the 10 percent difference. In addition, the term of the license issued to the Baku bureau of Radio Azadlig, expired on December 31, 2007. But the bureau led by Ismayilova operated illegally for a certain period in 2008.

The state prosecutor also said that Ismayilova, as a representative of the foreign media in Azerbaijan, had to be accredited in the Ministry of Foreign Affairs and pass the state registration. By not doing so, she was engaged in illegal activities.

The prosecutor said that Ismayilova led Tural Mustafayev to a suicide attempt. Having close relations with Mustafayev, Ismayilova knew about his engagement to a girl named Rovshana Rahimova and changed her attitude towards him. The defendant did not want Mustafayev to have any relations with other woman. Afterwards, Mustafayev was forced to leave the Baku bureau of Azadlig Radio.

Then, the prosecutor added that it became known during the investigation that while using her authority and necessary relations, Ismayilova hampered Mustafayev from getting a job in other media outlets and led him to a suicide attempt.

Hadiyev said that these criminal acts were proven by the investigative bodies. He urged to sentence the defendant to nine years imprisonment by adding penalties for criminal acts. After serving her sentence, Ismayilova will be unable to hold the senior positions in state bodies and local self-government bodies for three years.

The defense asked the court for some time to prepare a speech. The next court session will be held at 11:00 August 26.

Ismayilova was arrested under the article 125 (incitement to suicide) of the Criminal Code of Azerbaijan.

Then, new charges were brought against her under the articles 179.3.2 (large-scale misappropriation and embezzlement), 192.2.2 (illegal entrepreneurship), 213.1 (tax evasion) and 308.2 (abuse of official duties) of Azerbaijan's Criminal Code.
