Bill on intellectual property to be considered in Azerbaijani Parliament’s autumn session

Consideration of the bill "On ensuring the intellectual property rights and combat piracy" is expected in the autumn session of the Azerbaijani Parliament, Copyright Agency Chairman Kamran Imanov said today.

He said the bill will be submitted to the Parliament soon

"The penalties, envisaged by law, reflected in the relevant codes, including the Code of Criminal Violations, procedural codes. And each time, when new laws are adopted, these codes are brought into line with the requirements of new legislation. Our proposal in this regard have already been prepared "- Imanov said.

In the near future the Government intends to adopt a decision on the establishment of the Centre for ensuring rights (will work under the agency), which will have functions related to the support of the law.

The law "On ensuring the intellectual property rights and combat piracy" is intended to regulate issues to protect the rights of intellectual property rightholders, and determine the administrative and judicial proceedings related with the protection of their interests and preventing crime.

The third chapter of the law fully related to the fight against piracy. This chapter reflects specific rules relating to the digital encoding works, phonograms and other intellectual property. The law would also prevent the illegal use of information technology. Imanov said this is inevitable due to the increasing pace of economic development of intellectual property rights and acceleration of the integration of intellectual property in a system of e-commerce.

In accordance with the law, the court may make decisions on the prevention of admission to online trading pirated copies or counterfeit goods illegally imported by violating intellectual property rights, and fine persons, intentionally or unknown violating intellectual property rights for compensation for damage to the right holder.

However, the court by the offender may seize and destroy counterfeit products out of retail outlets, as well as to remove the equipment and materials used in the production of illegal goods without payment of compensation and not contradicting the terms of the existing legislation.
