Kazakh MPs approve ratification of agreement on hazardous waste movement through EAEU territory

MPs of Kazakh Parliament’s Mazhilis [lower house] approved the bill "On ratification of the Agreement on the trans-boundary movement of hazardous waste through the customs territory of the Eurasian Economic Union", Trend reports via the parliament's statement.

At the plenary session of the Mazhilis, the MPs reminded that the agreement was concluded in Cholpon-Ata on August 9, 2019.

The agreement regulates relations related to the trans-boundary movement of hazardous waste, to which non-tariff regulation measures are applied in trade with third countries through the customs territory of the Eurasian Economic Union (EAEU) in the course of mutual trade between the organization’s member states.

Trans-boundary movement of waste through the territory of a state that isn’t a member of the EAEU, when moving from the territory of one member state to the territory of another member state, is carried out in accordance with the provisions of the Basel Convention.

Control and supervision over the trans-boundary movement of waste are implemented in the member states in accordance with their internal legislation; and trans-boundary movement of waste for the purpose of their disposal and (or) neutralization isn’t allowed in the member states.

The trans-boundary movement of waste is carried out on the basis of an opinion issued by the competent authority in a single form approved by the Eurasian Economic Commission.

The requirements for the procedure for trans-boundary movement of waste not specified in the agreement, as well as for the carrier and the procedure for implementing measures to prevent and eliminate accidents, compensate for damage caused to human health and the environment, are determined by the legislation of the member states.

The Mazhilis committees positively assessed the agreement.
