On Oct. 29, 2013 Prosecutor General's Office of Azerbaijan began a criminal case against the officials of Election Monitoring and Democracy Studies Center and Volunteers International Cooperation Public Union, according to a message from the Prosecutor General's Office of Azerbaijan.

The case was initiated on articles 192.2.2, 192.2.3, 213.2.1, 213.2.2 and 308.2 of the Criminal Code on the basis of materials received from the ministries of Tax and Finance of Azerbaijan, regarding the illegal business activities of these organizations' officials. The officials are accused of obtaining large scale profit through abuse of office and tax evasion.

Numerous investigations have been carried out within this case, according to the message.

The Prosecutor General's Office said according to the court's decision, inspections were held in these organizations with the involvement of specialists from the Tax and Finance ministries, as well as the Council of State Support to Non-Governmental Organizations in order to conduct business accounting in accordance with the requirements of law, compliance with tax legislation, and to establish the legality of other financial incomes.

The Prosecutor General's Office said the evidence gathered during the preliminary stage of investigation and received on the basis of an interim inspection report, gave reason to say that in May 2013, Mammadli Anar Asef oglu, the co-founder and chairman of the Election Monitoring and Democracy Studies Center, which has no legal registration, and the center's executive director Suleymanli Bashir Suleyman oglu, agreed with the head of the Volunteers International Cooperation Public Union, Mammadov Elnur Akif oglu to formalize a grant agreement totalling $276,010.

This grant was provided to the public association, having state registration, by the U.S. National Democratic Institute.

However, the investigation has uncovered a reason to suspect that after Bashir Suleymanli's appointment as vice president of the Volunteers International Cooperation Public Union, the amount of $163,250 was cashed and misappropriated with Suleymanli's participation, and was transferred to Suleymanli's bank account.

Also the Election Monitoring and Democracy Studies Center, which does not have legal status, announced the reception of staff for the post of a manager for public relations, a lawyer, an expert and others, according to the message.
