Baku Court of Appeal Considers Appeal of Former Azerbaijani MP – Version 3

Azerbaijan, Baku / Тrend corr I. Alizadeh / We plan to apply to the European Court regarding the sentence by the Baku City Sabail District Court regarding Huseyn Abdullayev, Abdullayev's attorney, Javanshir Suleymanov, reported.

Notably, the Baku City Sabail District Court had sentenced Abdullayev to 2 years suspended sentence. The attorney noted that he and his client had no doubt as to the justice of the Azerbaijani court system. "We hope to achieve justice in the Azerbaijani courts. Otherwise, if necessary we will apply to the European Court on Human Rights," Suleymanov clarified.

On 6 August, the Baku Court of Appeal presided by Judge Rasul Safarov considered and rejected the appeal regarding the sentence passed by the Baku City Sabail District Court on 18 May with respect to Abdullayev (2 years of suspended sentence). The plaintiffs demanded that Abdullayev be acquitted and have his deputy mandate restored. The defence reported that an appeal would be submitted to the Supreme Court as soon as the decision of the Baku Court of Appeal is received.

A dispute in Parliament on 16 March between MPs Huseyn Abdullayev and Fazail Aghamaly resulted in a fight. Abdullayev was deprived immunity as deputy at the parliamentary emergency meeting on 19 March and was detained on the same day.

The Azerbaijani Prosecutor General's Office filed a criminal case in contravention of Articles 132 (assault and battery) and Article 221.2.2 (hooliganism) of the Criminal Code, while at the end of the investigation Article 132 was canceled. The MP was charged in contravention of Article 221.2 (hooliganism) and Article 128 (wilful infliction of damage to health). The Baku City Sabail District Court sentenced Abdullayev to 2 years suspended sentence. The Disciplinary Committee issued Aghamali with a reprimand.
