Administrative Courts to Function in   Azerbaijan by End of 2009

Azerbaijan, Baku, 18 September / Trend corr. K.Zarabaliyeva / The establishment of administrative courts in Azerbaijan will finish by the end of 2009.

The issue is still being solved whether administrative courts will function as a separate body within operating courts or independently and studies in this respect continue, Sayyad Karimov, the head of the Administrative and Military Legislation Department of the Azerbaijani Parliament, told Trend on 18 September.

"When studies finish, forms of functioning of these courts will be exactly specified in the project on the Administrative and Procedural Code," Kerimov stressed.

Under the draft law, which was adopted in the second reading, administrative courts will be two-stage. Boards on affairs of administrative disputes will be established at the Courts of Appeal and the Supreme Court. The boards, which will be formed at Courts of Appeal, will function as the first instance and the boards, established at the Supreme Court - as the second instance.

Solutions to election of judges to these courts, recruitment, allocation of administrative buildings to these courts, will be made by the end of 2009 after making concrete decisions on this matter, Kerimov said.

The Administrative and Procedural Code will be adopted at the Azerbaijani Parliament's autumn session, he said. The Code will enable to solve disputes arousing between citizens and officials, within a short time.

Experts believe that functioning of the administrative courts will enable to reduce number of complaints on administrative decisions at the juridical instances and to shorten work schedule of these courts.
