In case of the necessity the body exhumation of the former Azerbaijani President Abulfaz Elchibey can be carried out only in accordance with the criminal procedure law and by the court decision, the spokesperson of the Prosecutor General's Office Eldar Sultanov told Trend.
According to article 237 of the Criminal Procedure Code of Azerbaijan when it is necessary to exhume a corpse, the investigator shall submit a reasoned request to the prosecutor in charge of the procedural aspects of the investigation for an application to be made to the relevant court. Exhumation may be carried out only on the basis of a court decision.
The investigative process of exhumation of the body is open to family members or legal representatives of the deceased.
The Criminal Procedure Code does not contain any articles regarding obtaining permission to exhume the body from the relatives or legal representatives of the deceased.
Recall that Baku City Prosecutor's Office has filed a criminal case in connection with an attempt of deliberate murder of former President Abulfaz Elchibey (Aliyev) in mid-August.
Baku City Prosecutor's Office considered appeal of the 'Muasir Musavat' Party Chairman Hafiz Hajiyev on deliberate poisoning of ex-president Abulfaz Elchibey, Prosecutor General's Office spokesman Eldar Sultanov said.
During the investigation Hajiyev and others said that they have information about deliberate poisoning of Abulfaz Elchibey, prior to his death, which had a negative effect on his health, and that there is enough suppositions in this regard.
Based on the collected materials, Baku City Prosecutor's Office filed a criminal case under Article 29, 120.1 (attempt to deliberate murder) of the Criminal Code of Azerbaijan.
