Azerbaijani representative to European Court: There are problems with execution of court decisions in Azerbaijan

There are problems with the execution of court decisions in Azerbaijan, Azerbaijani representative to the European Court of Human Rights Chingiz Askerov told Trend.

"There are problems with the implementation of court decisions and these decisions are mostly related to the illegal capture of houses by IDPs. However, this problem gradually finds its solution. Houses are built for IDPs, and they are moving there," said Askerov.

In his speech at an international conference "Effective mechanisms and means of implementing the European Convention on Human Rights" dedicated to the 60th anniversary of the European Convention on Human Rights, Head of the Directorate General of Human Rights and Legal Affairs of the Council of Europe Markus Jaeger noted that there are certain problems with human rights in Azerbaijan.

According to him, the European Court considers that positive changes are needed in the question of freedom of the Azerbaijani press and journalists.

"Analysis of decisions made regarding Azerbaijan shows that in the country there are problems with implementation of court decisions and violations of right to life, freedom from torture and freedom of association. None of the decisions taken over Azerbaijan has been completely fulfilled," said Jaeger.

Commenting on Jaeger's statement, Askerov said that most of the decisions taken on Azerbaijan belong to 2002-2003.
"In Azerbaijan there are no problems with the registration of NGOs, the Committee of Ministers of the Council of Europe was informed that a new law was adopted, the registration procedure has been simplified," said Askerov.
According to Askerov, regarding the question of torture, the Court has made decisions with regards to all members of the Council of Europe.

"Most of the cases concerning Azerbaijan on violation of the right to freedom from torture are associated with the identification of violations of a procedural nature. That is, decisions are related to the fact that complaints on torture were not considered in the statutory time and upon all the rules," said Askerov.
According to him, trainings are conducted with staff in relevant agencies on these issues, specific recommendations are given to judges. According to Askerov, all decisions taken on Azerbaijan so far have been fulfilled, compensation has been paid to claimants.

"The decisions on some cases are impossible to be performed physically, and we are looking for ways to resolve them. One of these is the cases of Naila Humbatova against Azerbaijan," said Askerov.
