Azerbaijani Court of Appeal Considers Appeal of Former Azerbaijani MP

Azerbaijan, Baku / Тrend corr I. Alizadeh / Azerbaijani Court of Appeal has considered the appeal of the former MP of Azerbaijani Parliament, Huseyn Abdullayev, against the sentence passed for him (2 years of imprisonment).

During the meeting Abdullayev's attorney, Javanshir Suleymanov, submitted a petition to review the video cassette with the incident which appeared between Abdullayev and Fazail Aghamaly at a parliamentary meeting. The petition was not allowed.

A wrangle between the MPs Huseyn Abdullayev and Fazail Aghamaly that occurred in the Parliament on 16 March came to blows. Abdullayev was deprived of immunity of a deputy at the parliamentary emergency meeting on 19 March and was detained on the same day. The Baku City Sabail District Court sentenced Abdullayev to 2-year suspended imprisonment. The Disciplinary Committee issued a reprimand to Aghamali.

Abdullayv's attorney applied to court to acquit Abdullayev, but the state prosecutor Mohbaly Gurbanov protested.

After consultations the judges upheld the sentence passed by the Baku City Yasamal District Court on 18 May with respect to Abdullayev. It was noted at the meeting presided by Rasul Safarov that Abdullayev had right to submit an appeal within 20 days.

The Azerbaijani Prosecutor General's Office filed a criminal case in contravention of Articles 132 (assault and battery) and Article 221.2.2 (hooliganism) of the Criminal Code, while at the end of the investigation Article 132 was canceled. The MP was charged in contravention of Article 221.2 (hooliganism) and Article 128 (willful infliction of damage to health).
