The installation of POS-terminals at trade and service facilities in Azerbaijan is mandatory, the State Tax Service under the Ministry of Economy told Trend.
According to the service, the country has an approved the following list of facilities where the installation of POS- terminals is required:
- all business entities (facilities) of VAT payers, regardless of their turnover and territory (from the date of taxpayer registration for VAT purposes);
- specialized enterprises for the sale of cars and furniture, sports and recreation complexes, health care facilities, recreation and entertainment facilities, hotels, celebration houses, filling stations, points of sale and travel companies selling tickets to passengers by air, water, rail and road, regardless of their turnover and territory (from the date of registration of an economic entity (facility);
- all business entities (facilities) of taxpayers with an average monthly turnover of more than 2,000 manat ($1,1764) per quarter;
- vehicles belonging to legal entities and individuals, carrying passengers by car (taxi);
- state bodies that accept payment of taxes and state duties and fees for services (work) rendered.
"On January 1, 2020, the Azerbaijani Ministry of Taxes imposed sanctions for evading the installation of pos-terminals at trade and services facilities and refusing to provide them to customers. In the first case, the fine is 1,000 manat ($588.2) per calendar year. The penalty for the second violation during the same year is 3,000 manat ($1,764), and for the third and subsequent ones – 6,000 manat ($3,529)," the ministry said.
In accordance with the ‘criteria for determining the facilities subject to installation of POS-terminals’ approved by the Order of the Azerbaijani Cabinet of Ministers No. 219 dated October 4, 2012, a list of facilities where the terminals' installation is required has been determined.
