5% CASSATIONS, 10% APPEAL MADE ON CASES CONSIDER IN JAN-AUG

5% cassations and 10% appeals were made on the sentences both civil and criminal over cases considered in January to August of 2005, Ramiz Rzayev, the chairman of the Supreme Court of Azerbaijan, said. In 2004 the Supreme Court considered 3300 appeals on civil and criminal cases.

According to Rzayev, the appeals were made mainly on the civil cases. В"The court is a struggle. There is a winner and a defeated. Obviously, the defeated is always dissatisfied, while it does not he is right,” he underlined

Rzayev did not deny drawbacks in judges’ activities and asserted that some judges undertook unfair sentences. “The law defines the ways of revealing such cases. In particular, the complains addressed about the activities of the Judge of Nizami District Court were considered, Vilayat Nadirov, and the Juridical-Court Council appealed t e the President with request to cease his activities,” he underlined

According to Rzayev, the Supreme Court considers all appeals in unbiased and just manner. В"But I should say that any case one of the sides should bear loss and any disagreement should be accepted as obvious.
