The non-governmental organization Elections Monitoring Center and Teaching Democracy's (EMCTD) has brought an action on the Azerbaijani Justice Ministry. The court launched the judicial review of the appeal on Aug.31.
The EMCTD appealed to court claiming against Justice Ministry which refused to register the organization. The court received evidences and discussed the positions of the sides.
On Jan. 26, 2008, the EMCTD submitted the documents to the Justice Ministry, but the Ministry's central registration and notary department returned documents to the NGO on April 29.
The Ministry referred to absence of a resolution on establishment of the organization and approval of the Charter among documents submitted by the Center. Furthermore, the applicant incorrectly indicated the title of the law on non-governmental organizations (public associations and funds) in the latter of appeal, the ministry added.
Considering the ministry's actions as illegal, the founders of the EMCTD appealed to the Yasamal District Court.
Founder of the EMCTD, Bashir Suleymanli, believes the Justice Ministry's decision violated Article 58 (right for unifying) of the Constitution and Article 11 (freedom of assembly and unifying) of the Convention for the Protection of Human Rights and basic human freedoms.
The court will announce the final decision on Sep.2.
