Accused in Criminal Incident in Azerbaijani Gobustan Prison Sentenced to 2 Years Imprisonment

Azerbaijan, Baku / Тrend corr K. Zarbaliyeva / Under the decision by the Garadag Region Court regarding the incident that took place in Gobustan Closed Prison of Azerbaijan last October, Samir Aghayev has been sentenced to two years imprisonment.

According to the Spokesman for the General Prosecutor's Office, Vugar Aliyev, Aghayev was found guilty under Article 221.2.1 and Article 221.2.2 (hooliganism) of the Criminal Code.

An investigation of the case filed in this connection at the Investigation Department on Serious Crimes at the General Prosecutor's Office under Article of 308.1 (abuse of power) and Article 317.2 (break of normal activities of a prison or investigation cells) is in progress.

During a fight, Samir Aghayev injured Nurush Aliyev. On 28 October of 2006 he was charged in compliance with Articles 128 (deliberate health hazard) and Article 221.2.2 (hooliganism) of the Criminal Code. However, the criminal case on Article 128 was closed.

The head of Gobustan Prison, Sadagat Aghayev, and company commander, Elshan Mammadov, were both discharged from office due to inadequacies discovered in their work during the examinations of the Justice Ministry. The case was transmitted to the Investigation Department on Serious Cases at the general Prosecutor's Office.

At the meeting relating to results of the first half of the year, the former head of Gobustan Prison, Sadagat Aghayev, received a warning on his shortcomings in his work. He was given three months in which to improve. He was removed from office for failing in his duties to guard the prison .
