Trade Navigation Code to take effect in Turkmenistan

Turkmenistan, Ashgabat, Dec. 26/ Trend , E. Hasanov/ On Jan. 1, 2009, Trade Navigation Code will take effect in Turkmenistan west of which borders on the Caspian Sea, according to the parliament of Turkmenistan.

The legislative act was worked out by MPs and representatives of Turkmendenizderyaellari (Turkmen shipping routes). The document was worked out taking into consideration international norms and standard on regulation of the sea shipping relations.

The Code is based on provisions of international agreements on maritime law and rules of trade navigation including convention targeted at ensuring security of sea transport, preventing contamination of sea, protection of human life and maintaining skills of seamen which was signed and ratified by Turkmenistan.

The new legislative act will identify legal, organizational and economic framework of public administration in the field of trade navigation which includes activities related with the use of ships, cargo and passenger conveyance, baggage and mail, fish and other marine industry, exploration and production of minerals, tug and rescue operations and research, etc.

The Code regulates property relations in cargo transportation established between sea transport organizations and various physical persons benefiting from their services. The document regulates also signing of different agreements, sea agency service, mediation and insurance and responsibility to fulfill their terms. Moreover, the Code identifies status of sea trade port and way of exercising state control over ports. It also reflects aspects of protection of life and health and ecological security, protection of environment, biological and water resources. All norms of the Code concern all foreign judicial and physical persons as well.

Turkmen experts argue the Code will contribute to the efficient implementation of "programs and projects targeted at improving welfare of Turkmen people, enhancing regional and international trade and economic ties, further growth of national economy and strengthening Turkmenistan's position on international arena as a sea power."
