KMG EP refutes reports about allegedly negotiations in Zhanaozen

Kazakhstan, Astana, Oct. 6 / Trend, Trend A. Maratov /

In connection with the "Azat" party press release and statements from representatives of the party AO "" KazMunaiGas "(" KMG EP ") considers necessary to state that no negotiations for reinstatement dismissed for absenteeism of members of illegal protests by representatives of companies do not led and not lead, the press service of KMG EP.

"Representatives of the "Azat" party appealed to KMG EP's request for a meeting with representatives of company in Zhanaozen. KMG is committed to the principles of openness, ready for dialogue, so the consent was given and such meeting was held on October 4, 2011. The company was represented by Director of Production Branch "Ozenmunaygaz" ("HMG"), a member of the Board of KMG Kiykbay Eshmanov. The meeting was also attended by Zhanaozen mayor Orak Sarbopeev. In addition, the meeting was attended by a few laid-off persons from among the participants in the illegal protest "- said in a released statement.

Representatives of KMG EP reiterated that the company does not intend to restore to any of the work of 989 previously laid off workers for absenteeism OMG participating in illegal protests. Exactly the same is the position of the JSC "Karazhanbasmunai" about 993 employees of the company and two subsidiaries of transport companies (LLC "Argymaktransservis" and LLC "Tulparmunayservis"), dismissed for absenteeism. Layoffs were carried out in strict accordance with the Labor Code of the RK in the absence of these people in the workplace without a valid reason for a long time - from several days to three months. The legality of this decision was confirmed by the courts of Zhanaozen and Aktau, which denied the claims of several dozen people on the restoration to its former place of work. Allegations of a lockout (termination of employment contracts with workers by the employer in connection with their participation in the collective labor dispute or strike) by the company as baseless, as a strike in the OMG has not been officially announced and no conciliation procedures provided for by law, those who stopped working, have not been met.

"Thus, the failure to restore the company laid off at work is lawful and justified. This position adheres to the early days of illegal protest, which was repeatedly reported to the participants. This is clearly and definitely stated at a meeting with representatives of the "Azat" party" - noted in a press release

At the meeting it was also stated that a group of companies "KMG" endeavors and support in finding employment in the contract and dismissed affiliates. In particular, fired repeatedly offered to work in service companies engaged in repair and maintenance of wells, but these proposals were rejected.

The company emphasizes that, in accordance with the Labor Code of the RK, the employer must consider the requirements of the workers or their legal representatives in the face of trade union committee. Dismissed in accordance with the law are no longer members of the personnel business, and no requirement to nominate an employer can not. For the same reason, can not be created by the conciliation commission to consider their demands, including reinstatement.
