BAKU, Azerbaijan, June 21. Draft law on implementation of certain instructions of president was presented in Mazhilis [lower house] of Kazakhstan’s Parliament, Trend reports with reference to Kazakh media.
Kazakh Vice-Minister of National Economy Abzal Abdikarimov noted that the bill includes 5 blocks of amendments. Schedule for implementation of legislative instructions of Kazakh president is provided in this bill. President announced instructions at a meeting of Mazhilis on January 11, 2022 and another meeting with representatives of large local businesses entities on January 21, 2022.
Draft law also contains additional blocks of amendments introduced on behalf of government's leadership.
According to Kazakh media, amendments to the Law "On Public Procurement" provide for the reduction of basis for public procurement from a single source through the direct conclusion of a contract.
According to Ministry of National Economy, exclusion the right to acquire from one source is necessary for minimizing corruption risks and to develop competition:
- Goods to state material reserve;
- office premises, transport and other technical means, information systems, property and services for their maintenance by authorized agencies for implementation of operational-search activities;
- purchasing of a building, structure, premises having a non-residential purpose, determined by an act in accordance with Kazakh legislation.
Law “On Procurement of Certain Subjects of the Quasi-Public Sector” legislates obligatory coordination of the procurement procedure of Kazakh Samruk-Kazyna Fund [business corporation, investment holding] with Agency for Protection and Promotion of Competition of Republic of Kazakhstan.
Method of purchases within the framework of intra-holding cooperation is excluded in order to reduce non-competitive purchases of the fund. Draft law provides for the right of suppliers to appeal against purchases, regardless of the method of their acquisition.
Draft law also provides for further reform of inter-budgetary relations.
