Azerbaijani Election Monitoring Centre Asks to Annul Court Decision

Azerbaijan, Baku, 12 June / Trend corr. K.Zarbaliyeva / The Election Monitoring Centre (EMC) has requested to annul the court decision of the Khatai District Court to cancel organization's registration- which contradicts the Articles 17 and 20, the Centre told Trend on 12 June.

EMC first presented founders' documents to the Ministry of Justice on 14 March 2006. The Ministry did not register the organization attributing it to various technical shortcomings. At last, the sixth attempt of EMC turned out to be successful in February 2008.

The Central Registration and Notary Department of the Justice Ministry appealed to the Khatai District Court to cancel the EMC registration. A preliminary hearing was held on 5 May.

The Ministry of Justice attributes its decision to cancel the registration to the fact that the founders' documents of the organization give vague information about the founders, and the Ministry was not informed of the change in the legal address of the organization, and the organization also did not include any information about its representations located in eight Azerbaijani cities into the state register.

EMC considers that the right for fair investigation by the European Convention on Human rights has been violated during the judicial process.

The appeal by representatives of EMC to Khatai District Court to get familiar with the investigation documents was rejected. EMC Executive Director has unsuccessfully appealed to the Appeal Court of Baku a several times to obtain these documents.
