Azerbaijan to likely amend medical and sanitary care rules for detained foreigners

BAKU, Azerbaijan, October 31. New rules can be established for the medical and sanitary care of foreigners and stateless persons held in the detention center, Trend reports.

This issue is reflected in the amendment to the Migration Code, which was discussed today at a meeting of Azerbaijan's Parliamentary Committee on Legal Policy and State Building.

The draft mandates a medical examination for foreigners and stateless persons in the detention center within 24 hours of their admission, and mandates the creation of a medical book for each individual. Only medical staff, except in cases related to security measures, should conduct the medical examination.

During the medical examination, the medical staff must immediately inform the center's personnel if they detect any bodily injuries or establish evidence of torture or other cruel, inhuman, or degrading treatment prior to the individual's placement.

The appropriate executive body must promptly forward written information about complaints of torture or other cruel, inhuman, or degrading treatment, as well as about bodily injuries likely caused by such treatment, to the relevant prosecution authority for investigation.

The medical staff will immediately examine a foreigner or stateless person in the center if they become ill or sustain bodily injuries. The center documents the results of the medical examination and presents them to the foreigner or stateless person, as well as their lawyer upon request.

Doctors from other medical institutions may participate in the medical examination at the request of the foreigner or stateless person in the center or their lawyer, as decided by the center's head. The individual requesting the medical examination must cover the costs incurred by the invited specialists.

A foreigner and stateless person held in the center must undergo a medical examination by medical staff before being released or transferred to another center, which must be recorded in the medical book.
