Presently There is no Need to Hold Special Constitutional Reforms and Make Changes to Wording of Constitution  Azeri Constitutional Head

At present, I do not consider it necessary to hold special constitutional reforms and make changes to the wording of the Constitution, the Chairman of the Constitutional Court of Azerbaijan, Farhad Abdullayev stated in an exclusive interview with Trend.

Compared to other legislative acts, the Constitution should sustain fewer changes and remain stable. However, it does not mean that the Key Law should refuse any, even the most positive reforms. In my opinion, certain equilibrium needs to be kept between the stability of the Constitution and positive reforms, Abdullayev said. On the other hand, bringing the Constitution into conformity with the changing requirements and developing tendencies do not require, in many cases, for the text to be changed. It is not by accident that one of the key tasks of the Constitutional control bodies, of which responsibilities are to ensure the pre-eminence of the Constitution, is exactly to permanently develop the Constitution and its dynamism. It is realized through the permanent modernization of the legislation, court experience, including official commentary of the Constitutional practice.

In addition, Abdullayev stressed that applying the international law standard and court precedent is one of the important issues, which is permanently under the focus of the Constitutional Court. We take into consideration especially the items of the European Conventions regarding the protection of human rights and freedom and the main laws of the European Court on human rights. Undoubtedly, the international legal acts, particularly international agreement for ensuring human rights, should be broadly utilized in the court. It is of a great significance from the point of view of influencing the level and efficiency of the protection of human rights in Azerbaijan, the ideas and values specified in these acts, especially in the European Conventions that are developed in the resolutions of the European Court, he added.
